The geographical indication “Kuban apples” had been registered.

The Governor of the Krasnodar region Veniamin Kondratiev announced in the 10th of April 2019, that the registration of geographical indication “Kuban apples” had been received.
So, only producers, located in the Krasnodar Region & owning the certificate of Protected Designation of Origin, may use the geographical indication “Kuban apples”. The horticultural holding “Gamma Plus”, situated in Gulkevichy Area of Krasnodar Region, became the first right-holder of the name.
Another two geographical indications, “Krasnodar strawberry” & “Kuban early potato” are registering at the present moment. Veniamin Kondratiev said the main goal of this activity is to protect local producers against unfair competition & consumers – against product piracy. According to the Administration of the Krasnodar region, documents for registration of the producers of “Krasnodar strawberry” & “Kuban early potato” are pending in RF Ministry of Agriculture. Later they will be sent to the Russian Agency for Patents and Trademarks.
As contrasted with the trade mark, the registration of Protected Designation of Origin (“Kuban apples” is just the name like this) can be received by several producers at once. In order to make an application, it’s essential only to have the proper geographical location (within the borders of geographical area) & produce the goods with demanding characteristics. The Certificate of Protected Designation of Origin is issued after examination of patent application & available for ten years.
Even fair producer, met all needed requirements, has no right to use the name without demanding certificate. The penalty for improper use of Protected Designation of Origin is very serious – the compensation for damages in the amount of ten thousand to five million rubles or double cost of the good, for which the geographical indication is used improperly.
